Data Transfer Agreements

Data Transfer Agreements are contracts that outline the roles and responsibilities of each stakeholder and contractually bind them to ensure proper protection of data.
Data Custodians are required to sign two Data Transfer Agreements (DTA). These include a:

  • Data Transfer Agreement between the Data Custodian and the Data Linkage Unit; and
  • Data Transfer Agreement between the Data Custodian and the Researcher.

The purpose of the Data Transfer Agreement between the Data Custodian and the Data Linkage Unit is to:

  • Set out the responsibilities of the Parties to the agreement in conducting the Study;
  • Set out the responsibilities of the Data Custodian for the provision of data to the Data Linkage Unit;
  • Set out how the Data Linkage Unit will hold, maintain and administer data provided on behalf of the Data Custodian, and set out the terms and conditions under which the Data Linkage Unit is licensed to hold and manipulate the Supplied Data; and
  • Ensure the proper protection of the privacy and confidentiality of those individuals that the data relates to.

The purpose of the Data Transfer Agreement between the Data Custodian and the Researcher is to:

  • Set out how the Researcher will hold, maintain and administer data provided on behalf of the Data Custodian, and set out the terms and conditions under which the Researcher is licensed to hold and manipulate this data; and
  • Ensure the proper protection of the privacy and confidentiality of those individuals that the data relates to.

For single jurisdictional data linkage projects Data Transfer Agreements between Data Custodians and Data Linkage Units are signed when the data collection is first added to the State Data Linkage Unit Master Linkage Key and routine updates can be provided under this Agreement.  For cross-jurisdictional projects Data Transfer Agreements are project specific and will need to be completed each time data is transferred to the Data Linkage Unit.
